According to Live Law India, “The court ordered an inquiry under Section 202 of the CrPC and sought a police report on the charges against the siblings. Judge Bhagwat T Jirpe was hearing a complaint filed by advocate Ali Kasif Khan Deshmukh for the offense punishable under Sections 153-A, 153-B, 195-A, 298, 505 along with Section 34 of the Indian Penal Code. Advocate Ali has recently filed another complaint against Kangana Ranaut before the Andheri Magistrate Court for allegedly creating differences between Hindus and Muslims and an FIR against Kangana and her sister by a magistrate court in Bandra The judiciary was allegedly mocked after the order of filing. “
Metropolitan Magistrate Bhagwat T Zirpe also asked the police to submit the investigation report by December 5, 2020. The complainant stated that Rangoli Chandel had posted derogatory comments on Twitter related to members of Tablighi Jamaat on April 15, following which his account was suspended. On April 18, Kangana supported her sister and posted a short video on various social media platforms allegedly calling Jamaican terrorists. Live Law further explained, “Thus, both the accused posted hateful and derogatory statements against the Muslim community.”
According to the complaint, “They have misused social media platforms for cheap publicity and personal gain. The complainant approached the Amboli police for action against the accused. However, police officials have not taken any action against him. Thus, the accused have spread hatred against the Muslim community. “
Metropolitan Magistrate Bhagwat T Zirpe said, “The alleged video is not available on record. The allegations are based on the comments of the accused on social media platforms. Evidence against the accused appears to be electronic in nature. Therefore, the inquiry into the hands of the police is necessary for the proceedings against the proposed accused. Such an investigation would be helpful in determining the role of the accused. “
Judge Jaydev Dhule said, “I have found cognizable offense on prima facie allegations of complaint and submission. The overall allegations are based on comments on electronic media that are Twitter and interviews. The accused used social media such as Twitter and a thorough investigation by the expert is necessary. All offenses committed and charged against the accused are cognizable. In this case search and seizure is necessary, in such circumstances I have found it appropriate to pass order under Section 156 (3) of CrPC. “
