Solicitor General (SG) Tushar Mehta, who appeared for the NCB, told the court that the grant of bail has not been challenged. “My concern is that the court has made some broad comments about the NDPS Act, which disqualifies the act,” SG said.
The court responded by saying that the petition does not challenge the order of bail, but only considers the comments made by the HC in the judgment. “You can only challenge the order. The observations are prima facie, ”said CJI.
SG then asked for time to amend the petition. Giving time, the court has posted the case on next Monday (March 22).
Riya Chakraborty was remanded to judicial custody last year for drug related charges in the death of her actor boyfriend Sushant Singh Rajput. He was granted bail on the condition that he deposit a bond of Rs 1 lakh and not leave the country without the permission of the court.
The High Court granted bail to Riya, stating that she is “not part of a chain of drug dealers” and “has not forwarded drugs allegedly purchased by anyone else to earn monetary and other benefits”. .
